Information zur Online-Streitbeilegung: Die EU-Kommission stellt eine Internet-Plattform zur Online-Beilegung von Streitigkeiten (sogenannte „OS-Plattform“) bereit, die als Anlaufstelle zur außergerichtlichen Beilegung von Streitigkeiten betreffend vertraglichen Verpflichtungen, die aus Online-Verträgen über Waren oder Dienstleistungen erwachsen, dient.

....which shall be exclusively applicable also if no written confirmation has been made upon delivery of bids, orders or personal bids at the auction. 1. The auction takes place on a voluntary basis and with the exception of own lots in other names and for the account of others, against immediate cash payment in €. 2. The minimum raising is as follows: up to   50,00 € 2,00 € up to   200,00 € 5,00 € up to   500,00 € 10,00 € up to   1000,00 € 20,00 € up to   2000,00 € 50,00 € up to   5000,00 € 100,00 € up to   10000,00 € 200,00 €     above 500,00 € The purchaser shall pay the auctioneer a commission of 22% on the hammer price plus a fee of € 2,00 per lot. Postage and insurance are charged to the purchaser at cost. All these charges are subject to V.A.T. at the rate of 19%. This also applies to overseas customers. 3. Each lot is knocked down to the highest bidder. The auctioneer reserves the right to decline a bid or to accept a bid conditionally, to withdraw, re-arrange, split up or insert lots. In the event of equal bids ownership shall be determined by a draw. Room bids in order to be successful have to be one bid above the highest book bid. In the case of misunderstanding the autioneer shall be entitled to re-offer a lot. 4. The knocking down binds the buyer to take up the lot. As soon as the lot has been knocked down the risk lies with the buyer. The delivery of the purchased lot is charged to his account. Until full payment the stamps remain the property of the seller. Only after full payment of the auction invoice the purchased lots tan be claimed to be handed over. 5. The knocking down price plus premium are due for auctionroom bidders immediately, for outside bidders after receipt of the auctioninvoice. Whoever is bidding for third parties, takes over the responsibility besides the third party on his account. All accounts which are not received by the auctioneer 10 days after the end of the sale and/or receipt of the auction invoice, are subject to a delay payment of 2%. In addition an interest of 1% per started month will be raised. Is the buyer in default with his payment or does he refuse the acceptance he looses his right for the knocked down lots. The lots may then without further notice be sold outside the auction at his cost or auctioned once more. The original buyer in such a case is held responsible at the choice of the auctioneer for either eventual reduced proceeds and lost profits; neither can he claim eventual overproceeds. The auctioneer is entitled to claim all rights of the deliverer from his orders and from the knocking down in his own name. 6. Faults which may arise from photos (imperforation, perforation, centering, postmark etc.) cannot be made subject to objections. Objections must be received by the auctioneer within 8 days after handing over or delivery of the lots. In the case of justified complaints, lots and stamps have to be returned in their original state, i.e. in the state in which they were handed over by the auctioneer. All objections are waved if lots or stamps have been altered. Especially also the removal of hinges, hinge or paper remainders, watering, treatment with chemicals and the adding of marks of any kind is considered as alterations. For every lot returned by the buyer, the auctioneer is entitled to demand certificates from two different examiners, recognized and independent of each other. Costs for objections and subsequent expert certificates are not repaid to the buyer. All claims are waved if the lots are not paid for within the settime, i.e. by the latest 14 days after receipt of the auction invoice. For lots with more than 3 stamps no claims tan be made on account of minor faults. Stamps or lots which are described to be with faults cannot be objected for eventual other faults. Larger lots may contain unused and used stamps. No claims tan be accepted for collections, accumulations, dealer lots. Catalogue-prices are approximate. In special cases the auctioneer will grant an extension provided the purchaser informs him immediately in writing of the number of the lot and the name of the expert to whom it is to be submitted. All claims will be settled in the name and for the account of the owner. After payment to the consigner the purchaser is only entitled to raise objections against the consigner. The above conditions of sale also apply to all transactions performed outside the auctionroom with auction lots. Justified objections do not entitle to replacements. 7. The auctioneer is entitled, but not obliged, to refer the purchaser direct to the vendor or vice-versa, in the case of any claims. 8. Lots are described with the greatest care but without liability for the auctioneer. 9. Book bids shall be taken care of conscientiously and at no extra charge but without any obligation on the part of the auctioneer. Bids &at best 8 or similar shall be taken up to three times the printed calling-price and consequently may not be successful. In no case shall a lot be knocked down at the top bid and bidding shall always advance according to scale. 10. The auctioneer reserves the right to exclude any person from the auction without giving reason, especially such persons who during the auction are doing business, are exchanging or disturbing the sale, also bidders who have not taken up lots they have bought. 11. lt is agreed that any legal disputes shall be subject to the jurisdiction of the Law Courts of Munich, West Germany.
